These Terms and Conditions govern the “Active Trim Spring Bundle 2026” (the “Promotion”) organized by Brunswick Marine in EMEA., LLC (hereinafter “Mercury Marine EMEA”), located in Parc Industriel de Petit-Rechain, Avenue Mercury 8, 4800 Verviers, Belgium.

These Terms and Conditions are available in English and in your local language upon request.

1.           PROMOTION DETAILS

1.1.      During the Promotion Period, end-consumers purchasing an eligible Mercury outboard engine from an authorized Mercury dealer may benefit from Active Trim (the “Promotion Product”) offered free, subject to the conditions below.

1.2.      Availability of Promotion Product is subject to stock levels. Mercury Marine EMEA reserves the right to end or suspend the Promotion early if available stock is depleted. No alternative compensation or substitution shall be offered.

1.3.      Each Participant is eligible to receive a maximum of one (1) Promotion Product throughout the Promotion, regardless of the number of qualifying purchases made.

1.4.      Promotion Product is non-transferable, non-exchangeable, and cannot be redeemed for cash or any other alternative.

1.5.      In the event that the Participant returns the Eligible Engine, the Participant must also return the Promotion Product received from this Promotion.  For the avoidance of doubt this clause does not prohibit in any way the Participant’s right to exercise their applicable statutory or warranty rights.

2.           PROMOTION PERIOD

2.1.      This Promotion is valid from 11 May 2026 until 31 July 2026, inclusive, or until Promotion Product is out of stock in the Mercury Marine EMEA's inventory, whichever occurs first.

2.2.      Eligible Engine purchased outside of this period or after stock depletion will not be eligible for participation.

3.           ELIGIBILITY

3.1.      This Promotion is open to end-consumers

                 i.          residing in Belgium, Germany, and the Netherlands

                ii.          purchasing a new Mercury engine from an authorized Mercury dealer in Belgium, Germany, or the Netherlands, before 31 July 2026, from among the following (the “Eligible Engine”):

• Mercury FourStroke and ProXS outboard engines from 40 HP to 150 HP

3.2.      This Promotion is only open to end-consumers purchasing for non-commercial purposes i.e. end users. Mercury Marine EMEA reserves the right to verify the eligibility of end-consumer and/or to exclude end-consumer at its sole discretion at any time for any reason. Dealers may not submit claims on behalf of their customers.

4.           PROMOTION PRODUCT

4.1.

4.2.      The recommended retail price (MSRP) of Promotion Product depends on the country and will be communicated separately for Germany, Belgium, and the Netherlands. The Promotion value corresponds to this MSRP.

4.3.      Any additional equipment, accessories, or parts required by the end-consumer and not included in the Promotion Product kit may be charged by the Mercury dealer to the end-consumer.

5.           PRIVACY & DATA PROTECTION

5.1.      Upon registration, the Participant acknowledges that its personal data will be processed by Mercury Marine EMEA. Mercury Marine EMEA is an affiliate of Brunswick Corporation, which acts together with Brunswick Marine in EMEA, as joint controller.

By submitting its Personal Data to participate to this promotion, the Participant acknowledges that its data will be processed according to the Brunswick Privacy Policy available at https://www.brunswick.com/privacy-policy. Mercury Marine EMEA may appoint processors and sub processors to administer the promotion and conduct marketing and quality control analysis. Mercury Marine EMEA shall when using the services of processors, ensure that it enters into agreements governing the processing of the Participants’ personal data.

5.2.      Participants have the right to access, rectify, erase, and restrict the processing of their personal data. To exercise these rights, users can submit a subject access request at the following address https://www.brunswick.com/dsar.  

6.           DISCLAIMER

6.1.      Mercury Marine EMEA shall not be liable for any costs incurred by consumers or dealers in connection with participation in the Promotion, except as expressly stated herein.

6.2.      Mercury Marine EMEA reserves the right to modify, suspend, or terminate the Promotion at any time without liability, subject to applicable mandatory laws.

6.3.      Mercury Marine EMEA shall not be liable for delays, omissions, or failures caused by force majeure or events beyond its reasonable control.

7.      MISCELLEANOUS

7.1.   Complaints & Disputes - Any complaints or disputes related to the Promotion or these terms and conditions must be submitted in writing via our contact form by selecting “Media & Marketing” as the subject.

7.2.   Governing Law - These terms and conditions are governed by the laws of Belgium. This choice of governing law does not affect or deprive end-consumers of any mandatory statutory rights granted under the laws of their country of residence.
